Breach of Code of Conduct

The FHANA Code of Conduct is a standard of behavior that is signed by each FHANA member upon becoming a member and is renewed each year. Breaches of the FHANA Code of Conduct will be handled as followed:

1.    Breaches must be reported to the FHANA office in writing.

2.    Written notices will be reviewed by the FHANA Executive Director, the FHANA Board of Directors, and if deemed necessary, an ad-hoc Grievance Committee. Consideration will be given to the member(s) history in the association and patterns of behavior.

3.    Members who are deemed to have breached the Code of Conduct will receive escalating consequences as follows:

  • a.    Verbal warning
  • b.    Written warning
  • c.     Repeat Offenders may become Members in Poor Standing

Delinquent Payment

Delinquent accounts will be dealt with via the following procedure:

1.    30 days delinquent: Member will receive a written notice of the delinquency.

2.    60 days delinquent: Member will receive a second written notice of the delinquency, and all FHANA services are suspended. These include, but are not limited to:

  • a.    Foal registration and transfers of ownership
  • b.    FHANA Annual Inspections
  • c.     Access to the KFPS Database

3.    90 days delinquent: Member will receive a third written notice and become a Member in Poor Standing.

Upon receipt of payment of all outstanding amounts, including amounts that are not 90 days delinquent, the Member will resume access to full FHANA services per their membership level. They will also return to Member in Good Standing status.

Late Fees: Late fees on accounts that are 30 days delinquent or more will be charged a late penalty of 5% per month, compounding.

Collections: Members whose accounts are five (5) months in arrears will receive a final written notice. When an account reaches six (6) months in arrears, it will be sent to collections, per the discretion of the FHANA Executive Director and the FHANA Board of Directors.

Members whose accounts are sent to collections will have their FHANA Membership suspended. This suspension is not eligible for review until at least one (1) year has passed from the time the suspension was issued.

Bylaw Violation
Any member who knowingly breaches the FHANA Bylaws or FHANA Rules and Regulations, as determined by the FHANA Board of Directors, will incur the following penalties:

1.    First offence: The member in violation of the Bylaws will receive a written notice of the offence from the FHANA office, indicating the Bylaw in question and the details of the offense.

2.    Second Offence: The member will be placed in Member in Poor Standing for a period of three months.

3.    Third Offence: The member will be placed in Member in Poor Standing for a period of one year.

4.    Fourth Offence: The member will have their FHANA membership terminated.

Members may appeal the accusation of a bylaw violation by submitting a written response on the appropriate form to the FHANA Board of Directors within 30 days of receiving the notice of offense from FHANA.

Fraud
If the FHANA office and FHANA Board of Directors suspects a member of having committed fraudulent acts against FHANA or having fraudulently represented FHANA in any dealings, FHANA has the right to investigate these allegations as deemed appropriate by the Board of Directors. This may include, but is not limited to, third party investigations and legal actions.

If a member is found guilty of these actions in the appropriate court of law, then upon receipt of notice and verification that disciplinary action has been taken by an administrative agency, arbitration or other tribunal body, humane society or court of law, whether civil, criminal, arbitral or administrative and such action or judgment is final, the member’s FHANA membership will be terminated.

Member in Poor Standing
A Member in Poor Standing retains their FHANA membership. However, certain member benefits will be restricted or removed until the member regains their Good Standing status.

FHANA Member Benefits that are prohibited for Members in Poor Standing include, but are not limited to:

1.    Attendance at any event that requires a FHANA membership, including but not limited to the FHANA AGM.

2.    Participation in FHANA Inspections or FHANA Educational Clinics.

3.    Eligibility to run for the FHANA Board of Directors.

4.    Participation on FHANA Committees.

5.    Voting in FHANA elections.

6.    Participation in FHANA Awards Programs.

7.    Marketing via FHANA, including the FHANA Classifieds, FHANA website or The Friesian magazine.

8.    Sponsorship opportunities with FHANA.

Members in Poor Standing will be listed on the FHANA website until such a time as their Good Standing status is restored.

Board Meeting Viewing Agreement
Viewing of the FHANA Board of Directors Meeting Videos is governed by the agreement to not copy, record or share the videos in part or in whole. Breach of this agreement is subject to an immediate suspension of FHANA membership for a time period of two years from the date of the violation. This suspension includes all penalties listed under Members in Poor Standing as well as all other FHANA Member Benefits.

Any subsequent violations will incur further penalties as determined by the FHANA Board of Directors.

Egregious Offences
In rare occasions, where it can be documented that a member has intentionally committed an egregious offence against the Organization, the FHANA Board of Directors reserves the right to take immediate action bypassing interim steps outlined in the Penalty Table. Special action of this type requires a 66% majority vote of the entire Board of Directors in order to enact.
